Terms of Use
These Terms govern your use of the ProcurementXperts website and its public content. ProcurementXperts is the public brand associated on this website with Khubara Procurement Consultancy.
1. Acceptance and scope
By accessing this website, you agree to use it lawfully and in accordance with these Terms. If you do not agree, do not use the website. These Terms cover the public marketing website only. A signed consulting agreement, statement of work, purchase order, software licence, subscription or other product agreement may govern a specific engagement and prevail to the extent of any conflict.
2. Website information is general
Website content is provided for general informational purposes. It is not a binding offer, procurement recommendation, legal opinion, financial advice, or guarantee of a particular business outcome. A consulting engagement begins only when separately agreed in writing by the relevant parties.
3. Permitted use
You may browse the website and contact us for legitimate business enquiries. You must not misuse the website, attempt unauthorised access, interfere with its operation, introduce malicious code, submit unlawful or misleading information, infringe another person’s rights, or use the website to transmit information you are not authorised to disclose.
4. Intellectual property
Unless stated otherwise, the website design, text, graphics, logos, branding and other materials are owned by or used with permission by the relevant rights holder. You may not reproduce, adapt, distribute, publicly display or commercially exploit website materials without prior written permission, except where applicable law permits. Third-party names and marks belong to their respective owners.
5. Contact submissions and confidentiality
You are responsible for ensuring that information submitted to us is accurate and that you have the authority to share it. Do not submit confidential tender documents, supplier bids, personal data about third parties, trade secrets, credentials or restricted information through a general contact form unless we have expressly agreed an appropriate secure channel and the relevant terms in writing. A website enquiry does not by itself create a consulting, agency, partnership or confidentiality relationship.
6. EvalQ and separate product terms
EvalQ is a distinct bid-evaluation product. Access to or use of EvalQ may be governed by a separate end-user licence, order, support agreement or other product-specific terms. These website Terms do not grant an EvalQ licence. Product features, deployment mode, integrations, AI-assisted functions, data handling, support and updates are governed by the applicable product documentation and agreement. Do not reverse engineer, circumvent technical restrictions, or use the product unlawfully. The user organisation remains responsible for its procurement process, evaluation criteria, approvals and final award decisions; software outputs, calculations and AI-assisted suggestions must be reviewed by qualified people before reliance.
7. Third-party services and links
The website may link to third-party websites or services such as Google Fonts, WhatsApp, LinkedIn and EvalQ. We do not control third-party services and are not responsible for their independent content, availability, security or policies. Your use of those services is subject to their own terms.
8. Availability and changes
We may update, suspend or remove website content or functionality as needed. We do not guarantee uninterrupted, error-free or permanently available access. We may revise these Terms by publishing an updated version with a new effective date.
9. Disclaimers and liability
To the maximum extent permitted by applicable law, the website and its content are provided on an “as available” basis without warranties that cannot lawfully be excluded. Nothing in these Terms excludes liability that cannot be excluded under applicable law, including any mandatory rights that users may have. Subject to that limitation, we are not liable for losses arising solely from reliance on general website content, third-party services, temporary unavailability, or unauthorised use of information submitted through the website. Any liability arising from a separately signed engagement is governed by that agreement and applicable law.
10. Applicable law and disputes
These Terms are intended to be interpreted under the laws and regulations applicable in the Kingdom of Saudi Arabia, including mandatory applicable rules. Disputes are subject to the competent authorities and courts in the Kingdom to the extent permitted by applicable law and subject to any valid written agreement governing a specific engagement. The precise contracting entity and jurisdictional details must be confirmed before publication.
